Transactional

Trademarks

We represent local and multinational clients on Israeli and international trademark applications (pursuant to the Madrid Protocol), including conducting pre-filing market research of existing trademarks that may be considered identical or significantly similar, advising on the precise and adequate identification of goods and services, drafting and filing applications with the relevant trademark office, filing renewals and handling various office actions (such as objections and rejections by the examiner) as well as oppositions by third parties.

R&D and Licensing

We regularly advise entrepreneurs, start-ups, emerging growth companies as well as more mature companies regarding the development and commercialization of intellectual property, including providing specialist advice on incorporation, employment and engagements with service providers concerning the invention or creation of intellectual property rights as well as involving the protection of trade secrets. We regularly advise companies and development teams on compliance with open-source licenses in the context of their ongoing development as well as ad-hoc projects. Our practical advice includes drafting cross-company policies, mapping-out the relevant software components and their specific use, summarizing the applicable license terms in plain language and creating work tools and other “best practices” for developers to ensure compliance with the use of new technology while avoiding common pitfalls like being obliged to disclose proprietary source code. We also have substantial experience in dealing with open-source issues in the context of transactional work, including in due diligence for the analysis and assessment of exposures unique to software companies.
