EBN’s Dispute Resolution Department represents the firm’s clients in litigation proceedings related to competition law across all relevant judicial forums, including proceedings before the Israel Competition Authority (ICA) and the Competition Tribunal.

This litigation work is conducted in close collaboration with EBN’s dedicated Competition Department, which possesses unique expertise in all aspects of Israeli competition law.

Representative Experience

• Representing Mizrahi-Tefahot Bank in competition law litigation proceedings related to its NIS 1.4 billion acquisition of Union Bank of Israel.

• Representing Nesher, Israel’s largest cement manufacturer, in a class action certification motion valued at billions of NIS, alleging violations of competition laws.

• Representing Metro Motor, a leading importer of two-wheeled vehicles, in a class action certification motion alleging licensing violations and breaches of competition law, valued at tens of millions of NIS.

• Representing Goldman Sachs in a class action certification motion under competition law, alleging the existence of a global banking cartel, with claims in an aggregate amount of hundreds of millions of NIS.

• Representing the Japanese corporation ELNA in a class action certification motion under competition law, alleging the existence of a cartel among Japanese electronics companies, with claims valued at hundreds of millions of NIS.

• Representing Sabre, a global GDS (Global Distribution System) provider, in a lawsuit alleging violations of competition laws by Sabre and other GDS providers.

• Representing Nesher and Israel Lime & Stone Industries Ltd. in an appeal before the Competition Tribunal challenging the approval of a merger involving real-estate used for quarry operations.

• Representing class plaintiffs in two precedent-setting class actions with an aggregate value of hundreds of millions of USD against Google and Apple, alleging anti-competitive behavior and excessive pricing in relation to the operation of their app stores.

• Representing Mey Eden in an appeal to the Competition Tribunal challenging the ICA’s opposition to a merger between Mey Eden and Electra in the water dispenser industry.

• Representing Maman (Ground Handling & Logistics) in a hearing before the ICA regarding the Authority’s intention to declare Maman a member of a concentration group.

• Representing Mizrahi-Tefahot Bank and Bank Yahav before the Competition Authority, in connection with its intent to classify the banks as part of a concentration group.

• Representing Metro Motor in a hearing before the ICA regarding its intent to impose monetary sanctions on the company and certain officers for alleged violations of the Economic Competition Law.
